1. Who We Are
Omaha Building Permit Portal LLC ("we", "us", "our") is a private third-party permit expediting service. We are not a government agency and are not affiliated with, endorsed by, or operated by the City of Omaha, Douglas County, or any other municipal authority. By using this website or paying for our services, you acknowledge and agree to these Terms of Service.
2. Nature of the Service
We prepare, package and submit permit applications to the City of Omaha Planning Department (via Accela and related portals) on behalf of our clients. Our fee covers preparation, submission, and follow-up. The actual permit fees charged by the City and any plan-review fees, impact fees, or inspection fees are NOT included and remain the responsibility of the client.
3. No Guarantee of Approval
We do NOT guarantee that any permit application will be approved. Permit decisions are made solely by the City of Omaha and other applicable jurisdictions. Approval timelines, plan-review comments, denials, and requests for additional information are entirely outside our control. Our fee is for the service of preparing and filing the application — it is not contingent on the outcome.
4. Client Responsibilities
- Providing accurate, complete and truthful information.
- Providing all required drawings, site plans, contractor info and supporting documents in legible form.
- Paying all city-charged fees, inspection fees and contractor costs directly.
- Ensuring the work performed complies with all applicable building, zoning and life-safety codes.
- Hiring properly licensed and insured contractors.
You are solely responsible for the accuracy of the information you submit. Misrepresentations may result in the application being denied, revoked, or referred to enforcement, and we will not be liable for any resulting damages.
5. Not Legal, Architectural or Engineering Advice
Nothing on this site or provided by us constitutes legal advice, engineering opinions, architectural design, or code-compliance certification. For those services, retain a licensed attorney, engineer or architect. We may identify common issues as a courtesy, but you may not rely on us for professional advice.
6. Fees and Refund Policy
Our service fee is due in full at the time of submission and is generally non-refundable once we have begun work on the application (which begins immediately after payment).
- Full refund if you cancel in writing within 24 hours of payment AND we have not yet filed the application with the City.
- No refund after the application has been submitted to the City, regardless of the City's eventual decision (approval, denial, request for revisions, or abandonment by the client).
- No refund if the application is rejected because the client provided inaccurate or incomplete information.
- Government-charged permit fees, plan-review fees and similar third-party costs are governed by the City's own refund rules and are outside our control.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO YOUR USE OF THIS SERVICE IS LIMITED TO THE SERVICE FEE YOU PAID TO US FOR THE SPECIFIC APPLICATION GIVING RISE TO THE CLAIM. IN NO EVENT WILL WE BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST OPPORTUNITY, PROJECT DELAYS, RE-WORK COSTS, OR CITY-IMPOSED FINES.
8. Indemnification
You agree to indemnify, defend and hold harmless Omaha Building Permit Portal LLC, its members, employees and contractors from and against any and all claims, damages, losses, fines, and expenses (including reasonable attorneys' fees) arising out of (a) information you provided, (b) work performed under any permit, or (c) your violation of these Terms.
9. Communications and Records
By using our service, you consent to receive transactional emails (such as application status updates and receipts) at the email address you provide. We retain application records for our internal recordkeeping and to comply with applicable law.
10. Modifications
We may update these Terms from time to time. Changes are effective when posted at this URL. Continued use of the service after changes are posted constitutes acceptance of the revised Terms.
11. Governing Law
These Terms are governed by the laws of the State of Nebraska, without regard to its conflict-of-law principles. Any dispute will be resolved exclusively in the state or federal courts located in Douglas County, Nebraska.
